Overview

Welcome to Unearth Organics. The terms "we," "us," and "our" refer to Unearth Organics LLC. Unearth Organics operates this store and website, including all related information, content, features, tools, products, and services (the "Services"). The Services are powered by Shopify.

These Terms of Service, together with any policies referenced below (collectively, the "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers, limitations of liability, mandatory arbitration where applicable, and a class action waiver.

By visiting, interacting with, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use or access the Services.

Section 1 — Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence and that you consent to the use of the Services by any minor dependents on devices you own, purchase, or manage.

To use the Services, including browsing our online store or purchasing products, you may be asked to provide information such as your email address, billing, payment, and shipping details. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 — Our Products and Cosmetic Safety

2.1 Product representation

We make every effort to provide accurate representations of our products. However, colors or product appearance may differ from how they appear on your screen due to your device and its settings. We do not warrant that the appearance or quality of any product will meet your expectations or match how it appears online.

All product descriptions are subject to change without notice. We reserve the right to discontinue any product at any time and to limit quantities offered to any person, geographic region, or jurisdiction.

2.2 Cosmetic product classification

Our products are cosmetic products as defined under the U.S. Federal Food, Drug, and Cosmetic Act. They are intended to cleanse, moisturize, or otherwise support the appearance of the skin.

Our products are not drugs. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Statements made on this website, in our marketing, in customer reviews, or in testimonials have not been evaluated by the U.S. Food and Drug Administration.

2.3 Animal-derived ingredients

Our products contain tallow rendered from grass-fed beef and other animal-derived ingredients. If you follow a vegan diet or practice, these products are not suitable for you. A full ingredient list is available on each product page.

2.4 Safety, allergies, and intended use

You are responsible for reviewing the ingredient list before purchase and use. Although our formulations are designed for sensitive skin, individual reactions vary.

You agree that:

  • You will perform a patch test (apply a small amount to the inner forearm for 24–48 hours) before broader use, especially if you have sensitive skin, known allergies, or a history of skin reactions.
  • You will not apply our products to broken, damaged, infected, severely irritated, or recently sunburned skin.
  • You will discontinue use immediately and consult a qualified healthcare professional if you experience redness, itching, burning, rash, swelling, or any other adverse reaction.
  • You will consult a physician before use if you are pregnant, nursing, or managing a skin condition such as eczema, psoriasis, rosacea, or active acne.
  • You will keep products out of reach of children and avoid contact with eyes and mucous membranes.

Unearth Organics is not responsible for adverse reactions resulting from failure to patch test, misuse, or use contrary to these Terms.

Section 3 — Orders

When you place an order, you are making an offer to purchase. Unearth Organics reserves the right to accept or decline any order at its discretion. Your order is not accepted until Unearth Organics confirms acceptance and has received and processed your payment.

Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after an order is accepted. If we decline, modify, or cancel an order, we will attempt to notify you at the email, billing address, or phone number provided.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy.

You represent and warrant that your purchases are for personal or household use and not for commercial resale, export, or redistribution through unauthorized channels.

Section 4 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed, as shown in your order confirmation email. Unless expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges.

You agree to provide current, complete, and accurate purchase, payment, and account information. You agree to promptly update your account and payment information so we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method for the purchase; (iii) charges you incur will be honored by your card issuer or bank; and (iv) you will pay all charges at the posted prices, including shipping, handling, and applicable taxes.

Section 5 — Subscriptions and Auto-Renewal

5.1 How subscriptions work

We offer subscription purchases ("Subscriptions") through a third-party subscription service integrated with our Shopify store. When you enroll in a Subscription, you authorize us to automatically charge your saved payment method at the delivery cadence you select (for example, every 30, 60, or 90 days) until you cancel.

5.2 Pricing and shipping

Subscription orders receive free standard shipping within the contiguous United States. Subscription pricing reflects the per-unit retail price at the time of each renewal. We do not apply a recurring percentage discount to Subscription product pricing.

5.3 Changes to subscription pricing

We may adjust Subscription pricing, shipping inclusions, or product availability. If we make a material change that will affect your recurring charge, we will notify you by email at least fourteen (14) days before the next renewal. Continued enrollment after that notice constitutes acceptance of the new pricing.

5.4 Managing, pausing, and cancelling

You may pause, skip, reschedule, modify, or cancel your Subscription at any time by:

  • Logging into your customer account at unearthorganics.com and managing your Subscription directly; or
  • Contacting us at support@unearthorganics.com.

Cancellation is effective as of the next billing cycle. To avoid being charged for your next shipment, you must cancel at least 48 hours before the scheduled renewal date shown in your account.

Orders already processed for shipment at the time of cancellation will be fulfilled and charged; they are not automatically refunded. Refunds for such orders are governed by our Refund Policy.

5.5 Failed payments

If a Subscription renewal payment fails, we may retry the charge up to three times over a period of up to seven days. If the charge still fails, your Subscription may be automatically paused until you update your payment method.

5.6 Consumer rights

For customers in California, New York, Oregon, Vermont, and other jurisdictions with auto-renewal statutes, the cancellation methods above satisfy any requirement that we provide a simple online mechanism to terminate automatic renewal. You may also request cancellation confirmation in writing by emailing support@unearthorganics.com.

Section 6 — Promotions, Discount Codes, and Referrals

6.1 General rules

Discount codes, promotional offers, and referral credits (collectively, "Promotions") are offered at our sole discretion and are subject to these additional rules:

  • Unless otherwise stated, only one Promotion may be applied per order.
  • Promotions may not be combined or stacked with other discount codes, store credits, or promotional offers.
  • Promotions may not be applied retroactively to orders already placed.
  • Promotions have no cash value, are non-transferable, and may not be resold.
  • We reserve the right to modify, suspend, or terminate any Promotion at any time, with or without notice.

6.2 First-order and welcome codes

First-order discount codes (including any "welcome" codes such as WELCOME10) are valid for one use per customer and per household. We reserve the right to cancel orders and void discounts if we detect use of multiple accounts, email addresses, or shipping addresses to abuse a first-order offer.

6.3 Referral program

Our referral program allows existing customers ("Referrer") to share a unique link with new customers ("Referee"). The Referee receives a new-customer discount on their first order as stated in the referral offer at the time of use. The Referrer becomes eligible for a store credit once the Referee's first qualifying order has been paid, shipped, and passed the applicable refund window.

Referral credits:

  • Are issued as store credit redeemable only on orders of $50.00 or more before shipping and tax.
  • Are not redeemable for cash.
  • Expire twelve (12) months after issuance unless otherwise stated.
  • May be revoked if the underlying Referee order is refunded, charged back, or found to violate these Terms.

We reserve the right to void referral credits and take corrective action where we detect self-referral, fraudulent orders, or other abuse.

6.4 Minimums, exclusions, and floors

We maintain a minimum selling price for our products. Some Promotions may not apply to subscription renewals, multi-packs, bundles, gift cards, or already-discounted items. Exclusions are disclosed at the point of use.

Section 7 — Shipping and Delivery

We are not liable for shipping or delivery delays. All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather events, customs processing, or other events outside our control.

Once we transfer products to the carrier, title and risk of loss pass to you. Claims for lost, stolen, or damaged packages are subject to carrier policies and our Refund Policy.

Our products are anhydrous (water-free) formulations that may soften or become liquid in high heat. We package for temperature resilience, but extreme summer conditions or extended carrier delays may affect product texture. Product melted in transit is not defective; it can be re-solidified by placing the sealed jar in a cool location or the refrigerator, and performance is unaffected.

Section 8 — User-Submitted Content (Reviews, Photos, Testimonials)

8.1 License grant

When you submit a product review, photo, video, testimonial, question, answer, social media post tagging us, or other content in connection with our products (collectively, "User Content"), you grant Unearth Organics a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, display, and distribute that User Content in any medium and for any purpose, including marketing and advertising, across our website, email, packaging, paid advertising, and social media.

8.2 Your representations

You represent and warrant that:

  • You own or have obtained all rights necessary to grant this license.
  • Your User Content is truthful, reflects your honest opinion or experience, and does not describe outcomes you did not personally experience.
  • If you received any form of compensation, product, or incentive in connection with the content, you have disclosed it as required by FTC Endorsement Guides.
  • Your User Content does not infringe any third-party copyright, trademark, privacy, publicity, or other right.
  • Your User Content does not contain unlawful, defamatory, obscene, harassing, or otherwise objectionable material.

8.3 Moderation

We may, but are not obligated to, monitor, edit, decline to publish, or remove User Content at our sole discretion. We do not edit reviews to alter their substance.

8.4 No medical claims in reviews

We may decline to publish or may remove reviews that attribute medical or disease-treatment outcomes to our products (for example, claims that a product cured, healed, or treated a named condition). This is required to comply with FDA regulations governing cosmetic products.

Section 9 — Affiliate and Referral Partners

We operate an affiliate program through a third-party platform. Affiliates are independent contractors, not employees or agents of Unearth Organics. Commissions, payout terms, and eligibility are governed by the separate Affiliate Agreement accepted at the time of enrollment.

Affiliates may not:

  • Bid on our brand name or trademarked terms in paid search without written permission.
  • Make unauthorized medical, health, or outcome claims about our products.
  • Operate coupon, cashback, or deal sites that divert organic traffic.
  • Misrepresent themselves as Unearth Organics or speak on our behalf.

We reserve the right to reject applications, void commissions, and terminate affiliate accounts at any time for violation of these rules.

Section 10 — Product Storage, Care, and Shelf Life

Our products are anhydrous formulations preserved primarily by the absence of water and by natural antioxidants such as vitamin E. For best performance:

  • Store at room temperature, away from direct sunlight and heat sources.
  • Keep the jar tightly closed between uses.
  • Use clean, dry fingers or a spatula when applying; introducing water or contaminants can shorten shelf life.
  • Use within the recommended period after opening (PAO) shown on the packaging.

Natural variation in color, texture, and scent between batches is normal and does not indicate a defect. Exposure to heat during shipping may cause temporary softening or separation, which does not affect product safety or efficacy once re-solidified.

Section 11 — Intellectual Property

Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Unearth Organics, its affiliates, or its licensors and are protected by U.S. and foreign patent, copyright, and other intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Services without our prior written consent. Nothing in these Terms grants any license or other right to you under any patent, trademark, copyright, or other intellectual property of Unearth Organics, Shopify, or any third party.

"Unearth Organics," the Unearth Organics logo, and related marks, product names, designs, and slogans are trademarks of Unearth Organics LLC. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

Section 12 — Optional Tools

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor control.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind and without any endorsement. We have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk, and you should review the terms on which those tools are provided by the relevant third-party provider.

Section 13 — Third-Party Links

The Services may contain materials and hyperlinks to websites operated by third parties, including embedded third-party functionality. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. If you choose to leave the Services to access third-party materials or sites, you do so at your own risk.

We are not liable for any harm or damages related to your access of third-party websites or your purchase or use of any products, services, resources, or content on those sites. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third party.

Section 14 — Relationship with Shopify

Unearth Organics is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Unearth Organics. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Unearth Organics, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Unearth Organics.

Section 15 — Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit may be transmitted to and shared with Shopify and other third parties that may be located in countries other than where you reside, to provide services to you. Review our Privacy Policy for details on how we, Shopify, and our partners use your personal information.

Section 16 — Feedback

If you submit, upload, post, email, or otherwise transmit ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium and for any purpose, including commercial use.

You represent and warrant that: (i) you own or have all necessary rights to the Feedback; (ii) you have disclosed any compensation or incentives received in connection with submitting Feedback; and (iii) the Feedback complies with these Terms. We have no obligation to (1) maintain Feedback in confidence, (2) pay compensation for Feedback, or (3) respond to Feedback.

We may, but are not obligated to, monitor, edit, or remove Feedback we determine to be unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that violates any party's intellectual property rights or these Terms.

You agree that your Feedback will not violate the rights of any third party, will not contain unlawful, abusive, or obscene content, and will not contain viruses or malware. You may not use a false email address, impersonate another person, or otherwise mislead us as to the origin of Feedback. You are solely responsible for your Feedback and its accuracy.

Section 17 — Errors, Inaccuracies, and Omissions

Occasionally there may be information in the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

Section 18 — Prohibited Uses

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, state, provincial, or local law, regulation, or ordinance; (c) to infringe our intellectual property rights or the rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, or intimidate any employee or other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use material that does not comply with these Terms; (g) to transmit any unsolicited advertising, promotional material, "junk mail," "chain letter," or "spam"; (h) to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use of the Services or that may harm Unearth Organics, Shopify, or other users.

You also agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the Services; (e) use any robot, spider, scraper, data-gathering tool, automated process, or AI tool (including agentic AI) to access the Services except as permitted in Section 19; or (f) interfere with, bypass, or circumvent security features, robot exclusion headers, or other measures we use to restrict access.

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine you have violated any part of these Terms.

Section 19 — Agents

19.1 This Section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device without direct supervision.

19.2 No Agent may access, use, or interact with the Services unless it identifies itself and operates in strict accordance with Section 19.4 at all times. No Agent may access the Services if we have requested that the Agent refrain from doing so.

19.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.

19.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including "Agent/[agent name]" in the request's user-agent string; (ii) not conceal or obfuscate that any access, use, or interaction is from an Agent, including by mimicking human behavior or completing or circumventing CAPTCHAs or similar measures; (iii) respond truthfully to any question or prompt seeking to determine whether interactions are from a human or a computer; and (iv) not circumvent or otherwise avoid any measure intended to block, limit, or control Agent access to the Services.

Section 20 — Termination

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due through the date of termination.

The following sections survive termination: Intellectual Property, User-Submitted Content, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.

Section 21 — Disclaimer of Warranties

The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on it is strictly at your own risk.

EXCEPT AS EXPRESSLY STATED BY UNEARTH ORGANICS, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

Section 22 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL UNEARTH ORGANICS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PROCURED USING THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WHERE LIABILITY CANNOT BE FULLY LIMITED BY LAW, OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID TO UNEARTH ORGANICS IN THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS ($100).

Section 23 — Indemnification

You agree to indemnify, defend, and hold harmless Unearth Organics, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, payable to any third party arising out of (1) your breach of these Terms or documents incorporated by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim. Failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of any such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

Section 24 — Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed. The determination shall not affect the validity and enforceability of the remaining provisions.

Section 25 — Waiver and Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms and any policies or operating rules posted by us on this site or regarding the Services constitute the entire agreement between you and us, superseding any prior or contemporaneous agreements, communications, and proposals (whether oral or written), including any prior versions of these Terms.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

Section 26 — Assignment

You may not delegate, transfer, or assign these Terms or any rights or obligations under them without our prior written consent, and any attempted assignment will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

Section 27 — Governing Law and Jurisdiction

These Terms and any separate agreements under which we provide you Services are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions. You and Unearth Organics consent to exclusive venue and personal jurisdiction in the state and federal courts located in Marion County, Florida, for the resolution of any dispute arising out of or relating to these Terms.

Section 28 — Headings

Headings used in this agreement are for convenience only and do not limit or otherwise affect these Terms.

You can review the most current version of these Terms at any time on this page.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically for changes. We will notify you of any material changes in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services after changes are posted constitutes acceptance of those changes.
